waiting for probate to finish, to put the title of the house in my name can i claim the mortgage on my taxes?

You can deduct taxes only if: 1) you actually paid the taxes, and 2) you are the one who owed the taxes. If your sister’s estate paid or owed the taxes they are not deductible by you.

The house must be in your name, and you had to have paid the taxes on the property.
