why does a will have to go to probate court if there is nobody contesting it?

a friend of mine who’s mother passed away recently, doesn’t know why the will is going to probate, his mother didn’t own a car and didn’t owe money to anyone, only two sons and it is in the will that the 2 males get everything.

    The only reason uncontested will has to transfer title to an asset such as home car bank accounts or investments.

    There are still laws that affect how the will was done even if no one contests it. If the will was not executed under the appropriate laws then it is as if the deceased died intestate ( without a will). This is unfortunate but it does clean up alot of messes in the end.

    Also, you would be surprised how often no one challenges a will and then months or years later a child or sibling finds a document or finds out something about someone who got a big inheritance and then wants to challenge what happen…going to probate makes it official and prevents this from happening.
