My dad died, my stepmom is a sneaky skank, and I think we are being taken to the cleaners by her. I can not afford an attorney, I just want to know where I stand. Aren’t survivors entitled to a percentage of a parents estate, especially if he was retired officer in the Air Force?

Why would survivors automatically be entitled to a share of their parent’s estates? If there is no will, then the probate rules in your state determine who gets what. And houses and retirement assets often have to go to surviving spouses and, I think, surviving minor children. But if you are an adult, you are not entitled to anything. A parent can decide to leave nothing to his/her children.

It all depends on whether or not there was a will or a trust and in what state the deceased lived. If he died intestate (without a will or a trust) in California then the children (adult or minor) are entitled to a share of the estate. But if there was a will or trust then the terms of the will or trust decide the distribution of the estate.
