Do you have to probate a will in texas if there are no problems with it?

    If you don’t want to be sued by creditors of the estate or someone who was left out.

    If the estate is not that large you can probate under small estate statutes.

    Yes, all wills must go through probate in Texas. The reason is because it is the law in this state.
