My mom passed away in may 07 and we three brothers share equally in the estate. Is there a reason to have the will probated?

    If you don’t want to be sued by creditors of the estate or someone who was left out.

    If the estate is not that large you can probate under small estate statutes.

    Yes, all wills must go through probate in Texas. The reason is because it is the law in this state.
