Inheritance and property taxes- forced inheritance?

In 2007 my Husband’s Grandfather died. No will. Survived by two daughters. One in my Mother in law.

The two daughters do not get along well, and have fought for years.
After the death, my mother in law gave her sister paperwork so that she could go to probate court and get the property in her name- although they would receive it 50/50, she told the sister- go ahead and take it so we can keep it in the family. There was already taxes due on the property. She thought the sister was now the owner.

Right now, the house needs to be demolished- 100% unlivable, and more taxes due. It’s a money pit, but the lot is huge, and would be a good place to rebuild. It might be worth it to someone if all they had to do was pay court costs, lawyers fees and back taxes to get the lot for “free” past that.

Relatives come to her to say a city inspector came to look at the house. (they live next to it)

The city says either sign it over, or pay the taxes and keep it.

My father in law says he was told by the city that they MUST pay the back taxes on the property, they have no choice in the matter.

I said: don’t accept the property. Don’t accept the inheritance, and then you won’t be liable. The property is lost to the family, but you won’t be in debt either.

He said that if they keep or sign it over- they have to pay the taxes either way. My mother in law is all upset because it’s 3,000-4,000 in taxes she thinks she will be forced to pay unless someone in the family steps up and takes control of the property.

I told my father in law there is no way that someone can FORCE you to inherit something.

If that was the case, I would make sure I got a property, get loads of back taxes before I die and bequeath it to my worst enemy. It makes no sense whatsoever.

He keeps insisting they will be forced to pay these taxes on this property whether they keep it or not, that it’s city law.

Could this be possible?
Oh- and since she doesn’t get on with her sister, she doesn’t think she can give the property to anyone because the sister won’t sign over her share just to be difficult. (She doesn’t even have a current phone number)

I have an inheritance coming. However wondering how much I have to pay in the taxes?

Friend of the Family Passed On YEARS ago. I am 1 of 6 Beneficiaries to the sale of the farm land. The sale became Final 6 months ago. However the distribution of the $$ is with the Lawyers Accountant. I saw on his Final Layout that is going to probate court (for approval) “minus Town Taxes Paid” and then my portion. With my portion, do I have to pay taxes on it? You know, Inheritance Tax. And if so, how can I calculate so I know how much of the money I shouldn’t spend so I don’t owe later?
I would just ask them, but he is what you would call a “blood ******* lawyer” and I do not trust him. I cant decide who the lawyer is, this is the lawyer the deceased hired (unfortunately)

I think I’m getting screwed on my Keogh plan. My boss has not deposited a HUGE check he received for work.

My Keogh funds yearly on 10/15. I work for an attorney (I know…life just gets worse and worse) and he worked on a probate case which “closed” (per the court) last month (August). The check was for $27,000 plus. He has NOT deposited it into his business account, where all the other checks get deposited from all of our other clients. I think he is withholding it so that it isn’t “counted in” for the Keogh for this fiscal year; i.e. he’ll deposit it AFTER 10/15 so as to count towards next year (he’s supposed to retire by 9/1/08). Is this legal, his withholding a huge check so it won’t “count” towards this fiscal year’s Keogh contribution? I wouldn’t put it past him, though I may be wrong.

Will I receive my inheritance now?

My grandma passed away a little while ago, and soon after
I received a copy of her will which said I will be willed a small
inheritance, I think it was for $5,000

I was told, everything had to go to probate and be sorted out before I would receive anything.
This was around April 2007.

Today I received more papers from her personal representative, but I do not understand what they are for.

It is the Inventory of all my grandmothers assets
and it list all of her properties and the market value’s.
Total assets = $345,252.42

I am mementioned the one time in her last will
to receive $5,000 from what I have read and understand.

Do I have anything to do with the inventory and the total?
why was it sent to me?

And does this mean probate court is finished?
When could I get my inheritance?

My grandmother and her lawyer have been working on our estate for 17 years My sister and I were told he died bankrupt and we believed her. Three years ago I found out there was money. I finally now have PROOF of everything they hid from the courts.ALSO I found out the contact to the IRS is retired and they have been sending accountings to A BOGUS NON WORKING IRS PO BOX! I am sendning all the information to the criminal unit of the IRS, andd the Department of Justice. After listening to the video – it seems that this guy might *possibly* have and inside contact with the IRS.

I put the video up on youtube where I record him. Oh my gosh I am just in shock! I don’t know what to do….

Hi – I don’t know how many regular posters there are her in thhs forum – but i posted a link to a youtube page I did asking for help and exposing my dad’s probate case that has been open for 17 years.

Very quick synopisis – dad died when my sister and I were little girls.. Grandmother was named the executor. She told us he died bankrupt and disapeared. We believed her. In 2006 I discovred there was money there all along – but never had any real evidence or PROOF until now.
My sister and I were the only heirs.

With my youtube videos I was contaced by two bookkeepers at my dad’s company. I am FLOORED. Now I have evidence of axactly how much my grandmother and her lawyer hid from the I.R.S. OVER 120 thousand dollars pocketed since 1992. There are canceled checks and legal documents – and witnesses now that I can bring to court.

Not only that they hid this money from the I.R.S. ( my dad had an IRS lien), the probate courts, and they DECLARED HIM BANKRUPT – so that is bankruptcy fraud as well????

Can I save my fathers estate?

We have some rental property’s that are heavily mortgaged, when my father passes away will they be lost in probate court or do I get a chance to defend my family’s property? What if I have my own money and can continue to pay mortgage fees? Is there anyway I can avoid loosing everything in probate? Trust?

Can anybody advise how to file tax statements for 07-08 from an estate with the county clerk?

Does an administrator of an estate have to give the court a copy of all income tax paperwork?
