Can you get a continuance in probate court?
ladydodgecaravan asked:
My husband is going to probate for his parents. His father died in 2008 and mother in 2009. He is waiting for the money from his 401k to pay for the publication the court needs.
He is the personal representative for his mom’s estate. Also, does he have to file that or when he goes to court just ask the judge for a continuance.

Re: Legal Notice For Administrator Of An Estate?
DK asked:
My sister passed away last month. I have signed the paperwork to be the administrator of her estate. It was signed the week of May 9. The paperwork was carried to the probate court in the adjacent county. The judge was vacation that particular week but has returned. In my opinion, there has been more than enough time to sign the paperwork and submit it to the local paper for the legals section; however, the judge has failed to do so. Is there a time frame involved here? Once the papers are signed, how long does probate court have to get the legal notice in the legal organ? I have reason to believe there is some stalling here both on the part of the judge and on the part of a third party who was not related to my sister who’s trying to cause me trouble. If the judge is not going to do her job, seems they would need to notify me. I feel like I should drop the whole matter; it’s my opinion this judge could be crooked.

Georgia probate/ will contest – urgent?
Laureninal asked:
How can I petition the court to freeze an estate? A non-family member provided a will naming himself executor and beneficiary of my grandmother’s estate. I contested the probate (my mother whom he was married to, passed away in 2000), so technically he should NOT be doing anything with the items he’s stolen from my grandmother’s house…but he is selling them off!
I haven’t retained an attorney yet, but need to file some type of motion with the court and need to know the proper name. Thank you!!

My house is now held up in probate court and because of late payments for the house, now in forclosure, the probate lawyer for the state wants to sell the house. How many months into the following year do you have for a grace peroid on a estate to be settled?
maxcat2005 asked:
I am involved in a distribution of a estate submitted in 2009 everything was done all taxes were submitted and paid to the state and the irs. The hangup here is that the state has not sent a letter to the probate court in my town acknowledging the fact that the taxes were pd all they did was say it verbally. The money cannot be distributed until till probate gets that letter. I was told that there is a grace period on a estate settlement from 2009 to settle it so I was wondering how long the grace period is and what happens if the loose ends do not get tied up? We are so close to getting this estate settled and the money distributed. Even though it was stated that the state of connecticut taxes were pd and entered no letter has been sent to the probate court that is the hold up.
The state is Connecticut.
