Opening an estate for a deceased relative with no will?

I have to open an estate for my deceased relative who has been gone for at least the past five years. I was contacted after failed searches to reach any other living relative could not be found. I would like any insight as to how this procedure works. I am told I have to open an estate with the probate court in the county that they lived in. What should I expect? I would assume that there would be creditors and family members that are going to come forward. Of course there is a fee that I will have to incur. If family members do come forward, do they share in the cost to get this process started? Approximately how long is this process? Do we all have to go to court? How is the property divided? I am sure there are tons of other questions that I should be asking but since I have no clue what the process is; I don’t know what to ask. Any and all advise and comments would be greatly appreciated.

Bonnie Camblik the owner, Molloy the probate Lawyer, Sullivan the gudje in probate court and Cheryl Tompson of the Riverside County public defenders office who went along abusing the elderly through West Coast Conservatorship Inc. I need to find any record of a claim and/or settlement that was filed against the insurance company that bonded Bonnie Cambalik. This happened in court to my grandmothers case in Riverside County Superior Court of California in 1992 and Camblik representing more than 300 clients from 1986 to 1999. How do I find a current phone number and/or records of claims and settlements from Amwest Surety Insurance Company? Cambalik went to prison for 26 years and Molloy for 16 years.

Basically they are the beneficiaries of a us citizen estate (they are in Iran), and they like to sign a power of attorney and appoint a us citizen in usa as attorney in fact to disturbute the estate …..that’s why I need to find out if usa will accept a power of attorney from Iran or not,
I like to give more details regarding this matter..
We are already in a probate and I do already have a probate attorney but since the case in complicated that’s why I need to get help from more experts,
there is not will and we went to probate and we opened a probate, one of our family members in usa is the administrator of the estate and as I mentioned before the beneficiaries are in iran and they can not come to usa at all and they like to give away averything to somebody else in usa…
we have 4 beneficiaries in Iran, 3 of them are going to sign a disclaimer to pass the estate to the next kin which is in USA, but the last one has a minor child and since we do not want to appoint a guardian for her , we thought the last beneficary might be able to sign a power of attorney to give the person in usa a right to act behalf of her and give away her share of the estate to the next kin…I am aware of the inheritance taxes and we are going to pay all, but I need to find out if the power of attorney from her signed in iran (Switzerland embassy in iran) will be accepted by us court and us bank !!! non of the beneficiaries can not come to usa and they are not willing to come to usa…
In addition can the administrator of the estate give away the property or money from the estate to somebody else beside the beneficiary when there is no will or not!!

We have been waiting for four months now and when my husband calls the insurance people say they are waiting on the court system. I don’t understand.. please help! And now he has to go pay a bunch of money that he does’nt have to Probate Court, just to get his son’s settlement, in order to finish paying funeral expenses, and such. Is this true?

I think I understand it for the most part. My concern is that my mother didn’t have any assets. A house purchased with my brother and that’s it. A life insurance policy that’s just enough to pay for funeral expenses and possibly a headstone. I’m her eldest child named as the beneficiary to this life insurance policy. She was on state assistance about 15 years ago. (In CT) will they try to claim this little bit of insurance and leave us stuck with the funeral expenses? Her “estate” consists of this house which now belongs to my brother, “in survivorship”. Any advise is greatly appreciated.
