Do Siblings Have a Right to Harrass Sister Who is Executrix of Mother’s Estate?

probate court
Mary asked:

My mother’s estate has been in probate for over 2 years as a result of the inability to sell a property due to the poor housing market. My estranged brother sent me a threatening email saying he is having me investigated for stealing from an account the lawyer advised me to set up using money from a savings account my mother and I shared for the purpose of paying bills after she died. I have used this to pay bills for the past 2 years and my husband and I have done many maintenance and upkeep duties for free on the properties that were in the estate. I shared 2 other accounts equally with all my siblings even though my lawyer said that money has your name on it. you don’t have to share it but of course I wanted to do the right thing. I also shared IRA’s which I was the beneficiary of and equally shared the money from a home that sold. I included them in decisions I didn’t have to and kept them advised on some details but now my brother has pulled a sister in and they want records of EVERYTHING I have done over the course of two years with the money set aside to pay bills. I have nothing to hide but feel I also don’t have to bow down to their demands and accusations. No matter what I show them won’t be good enough and frankly I don’t have time to make copies and have meetings. My attorney does accountability filing with the probate court. Shouldn’t that be enough? Would anyone like to share their experiences with siblings who want to question everything and want answers they are not legally entitled to? I am so upset by their mistrust after working so hard to do what my mother wanted me to do.

What do i do when my stepmother has not probated my father’s will?

probate court
J-J asked:

sorry i couldn’t figure out the editing

My father died 3 weeks ago, and my stepmother has not come forward with a will. The probate court said there is a record of a will, but she has not brought it forth. If no will is brought forward am i entitled to anything? If it is brought to and says nothing of my name am i still entitled to anything in his name solely?
my father’s lawyer is my stepmonsters friend, and he was there an hour after he died talking to her, she is far from grieving, she also lied to others abouth where he died. i also think she is cheating on my passed father. my father’s family is from another country and speak no english. i am not a minor, my father was a real estate guru and had plenty for everyone!!!!

mdjmr10001 asked:

My sister has a 2 1/2 year old girl, and wants to give my mother (the child’s grandmother) and me ( the child’s uncle) guardianship rights… the father does not want anything to do with this sweet child. Do i just file paperwork through a probate court at my townhall? What should i do? The mother no longer wants her daughter…
