What laws were broken when documents pertaining to a relative’s will were forged in a beneficiary’s absence?
My friend’s grandfather died about 8 years ago. In his will she was one of six beneficiaries and was supposed to have received an equal share of the sale of his house and property.
While she was active duty in the Air Force, relatives of hers (the other beneficiaries) took the will through probate court where they were awarded more money each. My friend received a trust that was set up in her name for LESS than she was supposed to have received originally. The trust was to be overseen by a relative of hers until it was either given to her in part or full for reasons deemed important to her grandfather, like the purchase of a house, and/or car, help with college, etc. or until she was 30 yrs. old, whichever came first. (She will be thirty in a couple of years)
(I have always thought this was fishy, and her relatives are not good people. In my opinion, they never expected her to look into any of this or question it and she got royally screwed as a result.)
Since then my friend has purchased a house, bought a car, put herself through school, always had jobs, all the while being refused access to any money in the trust set up in her name. Recently, this relative threatened to not give her the money, ever, after she asked for some of it.
That is when we really started to dig.
I knew that her name would have to have been signed SOMEWHERE. Even with my limited knowledge of the law, I couldn’t imagine all of this being done in her name without her ever having to sign a thing!
As it turns out, we found her name forged on a document which states that she is in agreement with the new terms of the probated will and the trust. She never signed it, and she can prove that she was on active duty when this occurred, which means that they would have had to obtain an affidavit from the military for her signature. They do not have this.
We have also been able to find out that the relatives with access to this trust have been spending the interest and at one point had it moved into one of their spouses’ business accounts, for what purpose we do not know. Per the terms of the trust, they were supposed to be sending her monthly bank statements as well. She never received one in over 5 years.
They are now claiming (now that they know legal action is being taken) that they gave her money over the years and that they have some kind of proof. But what we think they are referring to is money given to my friend’s mother, without her permission, that they deducted from her trust. We aren’t too worried about this one since we see it as them basically giving her money away without consent.
Also, the original AND probated will are missing from the probate court records. They said it was either never filed with them or it was taken from the records. Weird…
We are supposed to receive a copy of the original and probated will at the end of the week. I have a feeling there is more shenanigans to come there.
She had to pull teeth to just get a few docs from one of the lawyers who handled the case. This lawyer refused to give her anything for YEARS until she was threatened with legal action. We have since reported this lawyer to the bar association, and as it turns out, she is a friend of theirs (her relatives). Big surprise there. This lawyer had the audacity to say to my friend, “I didn’t forge any documents. What do you want anyway, the money?” She wasn’t even being accused of forging them. Yeah,… shady right? We are pretty sure that this lady knew that some corners had been cut to rush this will through and was hiding it all along. She was a little too nervous for someone who had no idea what was in those files or any involvement.
So in a nutshell, it seems that they (her relatives), in an effort to receive a bigger chunk of the estate, took it to probate court in her absence, took this extra money from her share without her consent (with a forged agreement), set up this trust which has been moved around and the interest taken from it for their own use, made her pay the taxes on it one year even though the executor of the trust is someone else, and threatened to divide it up between themselves and not give a dime to my friend.
To give you an idea of what kind of greedy, selfish, jealous people they are they even deducted a car that her grandfather had bought for her (when he was still alive!!) from her share of the estate! We think that they went through his checkbook and deducted even more things that he had bought for her, even school books!! Like, I said, I don’t know too much about the law, but I’m fairly certain that they can’t touch gifts given in life.
This friend is like a sister to me and I have been helping her with this all along. Her grandfather was more like her father and he loved her sooooo much. I know he is turning in his grave over this. He gave her everything within his means when he was alive. These people have harassed her with threatening phone calls, and held this money ov

Ferrari 375 Plus 0384AM
Video of 1954 Ferrari 375 Plus 0384AM shot by CG on 09.24.10 inside and outside Ferrari Galleria, Maranello, Italy. CG and ex-factory racer Allen Markelson viewed, photographed, and video’d the car while on display, and then while being moved away from the museum. The Ferrari factory sold this car to Jim Kimberly in late 1954 after Ferrari had extensively raced it in the 1954 European racing season. Kimberly and Howard Hively raced it extensively in the American and Caribbean SCCA circuits from 1954 to 1957. On March 20, 1958, Kimberly sold this car to Karl Kleve, a Cincinnati, Ohio car collector and WWII Manhattan Project scientist. While disassembled, the stripped down chassis of Ferrari 0384AM was stolen from Karl Kleve of Ohio in late 1988. Kleve passed away in December of 2003, age 90, while still trying to recover his stolen Ferrari. At his death, ownership passed into Kleve’s estate. On October 27, 2006, the Ohio Probate Court ordered the ownership pass to Kleve’s heirs — his three daughters. Much of the car was not stolen, where it remains in Ohio to this day. In 1989 the FBI made arrests. In 1990, two thieves pled guilty to Interstate Trafficking of Stolen Goods, revealing that 0384AM had been exported. Meanwhile in 1989, the stolen portion of Ferrari 0384AM surfaces in Brussels, Belgium. Belgium officials impound the stolen portion as “0384AM”. Upon learning of this, Kleve seeks its return. In February of 1990, mysteriously and despite suspect paperwork with a …

If a spouse dies WITHOUT a will?
Does the spouse automatically get everything? I’ve heard conflicting answers.
I’ve also heard if there’s no will, then all assets will go through probate court. A certain percentage will go to the surviving spouse.
Does it depend on the state?
Again, this is for a spouse with NO will. Thanks.
I am just curious, nothing else. Thank you !!

Ex trying to threaten to overturn my step parent adoption because I won’t change our shared parenting plan?
My ex wanted to change our shared parenting plan, which we agreed upon after many months of a nasty court battle. The plan, shared custody and she’s with him every other weekend and overnight on Tuesdays, was agreed upon by us and our lawyers, and then went before court in February 2008 and signed into court order.
He wants to change it, and it’s only been 6-7 months. I don’t think it’s good for her, she needs consistency. It’s taken her months to even get used to going at all, and she starting crying and throwing up when he told her she was going to come an extra day (he did this without talking to me about it, and it took me a long time to calm her down and tell her that was not true and this was “grown up” stuff and shouldn’t be talked about with her.) I discussed it with him and he said he “never said that” and “she was lying”. (She is 8 1/2, and physically vomitted when I picked her up she was so “worked up” about it… she did NOT lie.)
Anyway, I’ve always been flexible, and will continue to be so. I’ve traded days for events often, etc… but I told him I didn’t think changing her actual schedule was good because she needed consistency. (And I saw her reaction to it when he and his partner discussed this with her.)
So now he’s threatening to go into probate court and try to overturn my adoption of her if I don’t agree to what he wants in domestic court. She is his biological daughter, but I’ve raised her since 6 months old and the adoption was official 2 years ago. Bio Mom signed away rights nearly 3 years ago and has never been heard from since (or for a year or two before actually). He says he’ll tell the court that “we” lied during the homestudy and they’ll “overturn it”. I never lied about anything. What happened was that shortly after the adoption was done, he left us, and “came out of the closet”. In the following year he only saw her once or twice a month, then started wanting more time only when I filed for divorce. He also threatens to have people come to court and attack my character and say that I had “relations” with them. He says he knows people who will “say whatever he wants”. He says court will think I’m a “wh*re” and take her. I’m sickened by his threats, but not surprised because this is “who he is.” He is also diagnosed bipolar but stopped taking meds years ago.
He’s basically trying to “blackmail” me… either give in to him in domestic court and give him more days, or he’ll try to overturn my whole adoption of our daughter. I’m the only constant in her life. Please tell me he can’t get away with this kind of thing…. Advice?

HELP ME OH GOD PLEASE HELP ME?
I’m 17 years old, completely miserable. I know most teenagers complain about wanting to leave where they live right? well… My situation is a bit different.. I’ve lived with my paternal grandmother eleven years and I have been depressed and sad since, constant fighting. I cry everyday I barely feel like I am alive anymore. I attempted ******* five times. I’m miserable.. my heart is so lonely. My boyfriend lives in Florida he came here and visited me and stayed with me at my real moms a week ago. ( I can’ stay with her shes poor) He asked me to come with him to FL and I was so close to going. But I figured to many problems would come of that choice.
Anyways my uncle would take custody of me but I know myself that could take years I’ll be 18 in a year… and I am so determined to not live in this horrid putrid house another year. I am to miserable for that. I’m trying to convince her to sign custody to someone… but as we know misery loves company so she needs me to feed into her **** I don’t know. I don’t think I deserve this.. life has always kind of ****** for me… I’m trying so hard right now so hard. I’m so afraid I wont make it. TERRIFIED. I’m not going to give up. But everyday seems to get harder for me. It could take years for my uncle and aunt to get custody… and I am not stupid enough to run away people could get into a **** load of trouble. I don’t see how the court would grant me emancipation I don’t have a job which I am not allowed to get the devil I live with will not let me… I still try though. . and I cannot support myself. My BF wants me to go down to FL to live with him and his mom. I’d finish school there and be so happy…my uncle suggests I go to the probate court to be granted permission to marry my BF..were very in love but I’m only seventeen. how exactly does emancipation work? If I just ran away what would happen? What if I went to court and told them all this? I have a lot of peers and adults taht know how bad things are they can vouch for me. would I be granted emancipation ? Oh god… If we got married then I would be emancipated. What can I do. Staying here is not an option… and to say **** IT UP tears me up… I feel pathetic I can’t be here one more year before I’m 18 I’m home schooled online school I have to sit here 5 hours a day with my gramma while she yells at me I CAN’T TAKE THIS!!!!.. for one year all I want is….happiness I feel so selfish.. help me?
