Question re: a will/probate of a house and other property?
mnm asked:
The will says it’s 50/50 for a house, but instructs one of the adult children to pay a specific dollar amount to the other sibling. However, the dollar amount listed is 50% of what the house was purchased for many years ago. Shouldn’t there be a new appraisel to be fair? One wants the house and is no doubt trying to get a good deal and rip off the other. No love lost here. Additionally, the will was written before one grandchild was born. Shouldn’t that child receive the same amount as the named grandchildren? Does probate mean all of this will go to court and likely be fair as opposed to the one person trying to convince the other to agree to what’s good for the first? By the way, the house HAS increased in value even in this market.

if you are appointed beneficiary for a structured settlement of a minor, does that change when he becomes 18?
pamiwami asked:
I have a friend who’s son was receiving monthly payments set up through a structured settlement, as the result of losing his mother in a car accident. At the time the structured settlement was set up, the son was a minor, so my friend, his father, automatically became benificiary of the settlement. Now the son was killed 2 months ago in a car accident at the age of 19. My friend, his father, has been contacted by the insurance company about the remainder of the settlement. My friend filled out some papers and sent to the insurance company. They contacted him again and told him that when his son became 18, that he was no longer beneficiary, and that no one was because the son never appointed one after he turned 18, and now the remainder of the settlement would go to an estate for the son. And now he has to go pay a bunch of money that he does’nt have to Probate Court, just to get his son’s settlement, in order to finish paying funeral expenses, and such. Is this true?

Someone owes me $3500. I found out he died 1 yr ago& that his estate is in probate. What should I do?
The Office Fan asked:
I would like to collect the $ without hiring a lawyer. I am in California & the court where the probate is being handled is in Calif though in a different county. Thanks.
Yes, I have a promissory note but anything you can tell me about how to go about collection (of the debt) will be appreciated. Would it help to write to the executor of the estate? How would I find out who that person is? How do I file a claim? Any advice would be appreciated. Thanks.
