what happens to my savings and assets upon my death? I understand some states have no probate?
curtis s asked:
I know my father moved to a state that had no probate so none of his savings or assets were seized by probate to be adjudicated. I live in wyoming and am looking for a way upon my passing that my exectutor would handle my wishes and not have the courts involved. I know nothing of probate and not talking a lot of assets or money. It would be under 50,000.

Probate court and cost basis?
N H asked:
Mother recently passed away in Michigan, leaving a will and her house. An appraiser has looked at the house and that will be filed with probate court on the inventory. Does that amount then become the new cost basis? I had read somewhere that the cost basis could be the sale price of the house? Also, can the heirs claim a loss on the sale of the house? Thank you so much for any answers.

Tenant died before rental agreement expires 4-1-08. Trust in probate. Probate responsible until end lease?
jeremieanderika asked:
Tenant rental agreement 1yr ending 4-1-08. Tenant died 12-30-07. Daughter is occupant & living there. Trust in probate. Is the tenant’s probate responsible to pay until lease expires end of March? Daughter is only listed on lease as occupant not tenant. She is only heir but has no access to money for at least 6 weeks. Must I sue for balance of lease if she can’t pay? Or does lease die with tenant?

What does “Grant of Probate” mean?
Nirmala asked:
My mother in India has some money in the United Kingdom. She asked the bank, how she can ensure that , in the event of her death, how she can transfer the money to her children. The bank replied in legal terms that we do not understand. Please help clarify it all for us. Here is what they said: “We will require the Grant of Probate, being re sealed at a probate office in the UK before any funds could be released”
What does this mean in practical terms ?Thank you for your help.

Do I need a probate attorney for this?
Tony S asked:
I recently married a widow that has an existing valid will, leaving everything to her only child daughter from the first marriage. After four months of marriage, my new wife died before we could revise the original will. Step-daughter has now expressed interest in trying to nullify the original will and making me, the new husband, the sole beneficiary. We have gotten along well, so far, but my inclination is to just execute the existing will. Let her have everything and perform her duties as both executor and sole beneficiary. Money-wise ..assets v. debts.. it will be a wash.. so that isn’t a factor.

Can anybody suggest why I shouldn’t just hunker down as a legal nobody in the current picture and let the original will probate out?

Do I have to open an estate or probate for my Father, is my Mother liable for his debts. (CA resident)?
Mari asked:
My Father left or has no assets (property). Has left about $30,000 of debt which is solely in his name: Credit cards, student loan for my brother & other small misc loans. The only thing left to my Mother is his monthly pension of $817 and a lump sum benifit of $18,000. To pay for final funeral expenses.
