Can I refinance a mortgage that is in probate?
Jesse G asked:
Everything was left to me. I don’t have the immediate cash to pay off the debts. And I don’t have perfect credit. But mother had bills and I desperately want to keep the house!!!!!!!!!! I have paid the mortgage payments for almost two years now. Or if there is any other suggestion that will help me keep the home…PLEASE let me know. I reside in Kentucky if that helps any.
I am the executrix and I do have a lawyer. I don’t think he is doing his job……..but I do have a lawyer.

Texas Probate of will Real Estate?
SRG asked:
My parents passed away over 10 yrs ago. In their will they left equal parts of the property to all of their children. The will was never probated and my sister has been paying the taxes on their beach cabin since this time. She was not listed as the executor to the will. Are there any rights that she has to this property that do not apply to the other siblings?

Can I still pay my Mother’s house payment after the probate process is over?
Shawn P asked:
I am paying my Mother’s house payment while it’s in probate of 400.00 a month with a balance owed to the USDA for 7,000.00. Once the property is deeded to me can I still pay on her loan or do I need to come up with pay off? I have poor credit and not much money saved…
I am the executor… Should I have lawyer extend probate till summer???

Can a lawyer file a will in probate even if the waivers are not signed?
bdsm_rockstar asked:
My mother and my uncle are contesting my grandfather’s will. The lawyer says he will go on and file the will after 10 days in probate with or without the waivers and state that the heirs who do not sign the waivers are being “uncooperative”. My mother has a lawyer who she will show the papers to on Monday, but I was wondering, can the will be filed without the waivers? Should my mother go ahead and contest the will before the 10 days are up?
