do you have to probate a will if the deceased belongings do not add up to $5,000?

My husbands father passed away, and left every thing he owned to my husband. When he passed away owed money to a finance company. I don’t think he has enough money in his bank account to take care of the debit. So would my husband and I be liable to pay his debit out of our pocket?

NYS – Need to file in probate court if my father passed away without a will, but held all property jointly?

The mortgage was his only debt – do we still need to file in probate court? Or can I just file for a letter of administration? There’s no disagreement among the heirs about who gets what (we all live together, and there’s really nothing to distribute). Well i think she wants us to sign a waiver saying we do not want to contest the will. Which we won’t.

What is an assigment & transfer of personal property to revocable living trust? Does it help avoid probate?

We found a form with his trust titled “assignment & transfer of peronal property to revocable living trust” that states he transferred all his property to the trust. If he did not draw a new deed stating the trust owns the property, does this form help at all to void probate? What is it for?

I was made executor on my dad’s probate but the person who was removed won’t had over the documents?

Can I legally call the local courts and simply ask for the date that my father’s estate’s probate is set for?
