My father passed away 6 months ago without filing a will. He and I held the house jointly (we live in New York city, Queens county, specifically), and all of his other accounts were held jointly with my mother. The mortgage and the car are probably the only things that are specifically in his name (and the mortgage may actually list me as a co-borrower – the bank and I are hashing that out). The mortgage was his only debt – do we still need to file in probate court? Or can I just file for a letter of administration? There’s no disagreement among the heirs about who gets what (we all live together, and there’s really nothing to distribute). Also, is there any sort of time limit as to when everything needs to get filed and done?

Well i think she wants us to sign a waiver saying we do not want to contest the will. Which we won’t.

If he did not draw a new deed stating the trust owns the property, does this form help at all to void probate? What is it for?

I was made executor on my dad’s probate but the person who was removed won’t hand over the accounting from the sale of the house so we can see where the $ has gone. What can I do if she continues not to give information? I have an attorney but they keep saying she hasn’t sent the papers and it’s costing me $ everytime they call to ask her lawyer is she has given him the info. I don’t trust the executor. So I need to know, Can I call the court house and expect to be told the court date for the settling of the estate? Or is that something that would be kept from me like (as an example) a doctor’s apt date simply because I’m not the right person (the executor)?
