does a sole proprietor business have to be run down to settle probate?

if a sole proprietor of a business dies with out naming any one to take over , but a legal heir wishes to continue the business,the very person who had been running the business for the decedent,and their are no objections from the other heirs,and the business is a family business of some 50 years standing,and said heir wishes to continue to honer decedent,but also since it is the sole income for heir for some 50 years,and heir wishes to continue business in name of decedent, can the presiding judge allow that heir to take over and continue to run said business?(the administater of the estate has been running that business right along,so the business never stopped ).with out closing the business down,so that it does not have to be reopened?

California Probate Law- Who does the estate go to?

My daughter’s (who is 2) father passed away a few weeks ago and there was no will filled out. He was co-owner of a house in California with his sister. Now that he died she is claiming that his half of the property belongs to her! Is this true or does his estate go to his daughter? I am confused? I Need Help With California Estate/Probate Law! Where do I start? Muni, Superior. Anything internet?

Parents left a will for 3 adult children to split 3 ways. 2 of them conspired (one being the administrator of the will) to cut the 3rd sibling out. The 3rd child was told by both parents of a $250K policy to be evenly split. Mom was ill and hospitalized. She kept asking for 3rd child, unable to understand why he had not come to see her or call her. Mom passed away 1 hour before 3rd child was finally told “mom is sick and it does’nt look good”. They recently slipped and mentioned “6 death certificates and “The Insurance Company”. Most recent, both of them say that there was nothing left after all of the expenses. His brother had the guts to say that the sister was the one who came up with the idea. He was and still is. He has lost everything in his life. .
We don’t know if it’s a trust, insurance policy, his parents will that he has never seen or was offered to see. I need to help him but i am getting frustrated and nowhere. Help me help Him!!

Am I likely to need our marriage certificate to probate the estate of my spouse?

There is no will, so my appointment as an executor is not pre-named.
