It appears from what I have read a Mississippi Probate Attorney is absolutely required for an Executor to handle a will.

Is that correct?
All Mississippi estates must be represented in court by a Mississippi probate attorney. This is required by Uniform Mississippi Uniform Chancery Court Rule 6.1, which requires every fiduciary (such as an executor or administrator) to be represented by an attorney unless such fiduciary is an attorney.

The way I’m reading the above it’s required by statute.

My father passed last year with no will. I need a probate attorney and to become executor of his estate. I’m looking in to finding an attorney but don’t want to get ripped off. How much should I expect to pay the attorney? I’m aware of the fee scheduele, 4% for the first $100,000 of estate and so on. But should I expect fees over and above that, like the attorneys hourly fee? What is reasonable for an hourly rate?

I was made executor on my dad’s probate but the person who was removed won’t hand over the accounting from the sale of the house so we can see where the $ has gone. What can I do if she continues not to give information? I have an attorney but they keep saying she hasn’t sent the papers and it’s costing me $ everytime they call to ask her lawyer is she has given him the info.
