Can the disbursement of a will be contested after probate? Is there a time limit?

When my father died I had a note that I owed him but later I declared bankruptcy and he was listed as a creditor and the amount included the note. When he died, the family felt I still owed him the money even though legally I didn’t. I was in a pschiatric hospital for months during that time and they bullied me into signing papers that said I still owed the money and so I lost $27000 of my inheritance. That was a little over 5 years ago. Can I still contest that?

I know attorneys are busy, but they should at least have the courtesy to update you — at least on a yearly basis!!! The deadline on the probate was 2 years ago. At this point, I still do not even know who has filed a claim. This is a small town in Arkansas, and being probate has to stay within the county. So far, I’ve not even found another attorney to step in. I suppose this has to do with not crossing the territorial lines of their colleagues. At what point is it criminal for an attorney to take money and then not complete a case at his own choosing and not having the “ethics” to keep you informed?

can a probate inheiritance be siezed to settle a tax lein?

My step-father recently passed on 12/10/06 and his daughter and son the day of his death were rummaging thru the house he and my mother, his common law wife of 8yrs, shared. They told my mother if they were left the house they wanted to give it to her, now his daughter went behind my mothers back and is trying to get all the money and property for herself. She was blabbing out at the luncheon we had after his funeral that she is power of attorney. Now if she is power of attorney doesn’t that mean there is a WILL? We have documentation that my mother paid half on the mortgage, isnt she entitled to the house and to his truck which she paid off in 2005? Are there any loopholes to this situation? His daughter is trying anything and everything to get all the money because she found out my mother is a beneficiary to his life insurance policies, his IRA’s, and possibly to all of his bank accounts. What kind of lawyer can we talk to? They even stole my mother’s files for her business.
