My husband died recently. There was no will, no life insurance, no savings or investments, and no real estate. I am hesitating to spend what little I have on a probate lawyer, as I am certain that due to medical expenses and his personal unsecured debt, the net estate of my husband is several thousand $ negative. Is probate required?

Even if part of an estate had a 50% death tax, over a few decades, wouldn’t such a sum, invested, and interest compounded, dwarf the immediate cost of taxes?

So far, the will has not been read and our step-mother is asking us all to sign an affidavit and indemnity agreement which sounds to me like it will put the entire estate and insurance in her name.It says the insurance will be transfered into her name. My father lived comfortably and had lots of assets. It has been over 5 months and we were expecting probate or something to happen. Should we sign this affidavit. It sounds fishy to me. And when should probate take place. This paper also says that probate is not expected.

my mother-in-law’s house is set to be foreclosed on. My lazy sister-in-law is living there rent/mortgage free and because she hasn’t paid anything since her mom died, it’s going to be foreclosed. Neither myself or my wife want the house. She, my sister-in-law says the mortgage holder cannot foreclose while the house is in probate- is this true in SC? Anywhere else?
